JetAway has filed an appeal of the judge’s decision to dismiss their anti-trust case against Montrose County. The now defunct fixed base operator filed an Anti Trust suit against Montrose County after the county denied them access to the airport after safety violations that were disputed by the company. The county also fixed the annual use fee at a rate more equal to other businesses like JetAway at the airport. The federal suit was dismissed last month and JetAway was ordered to pay nearly $250,000 in fees and costs. The appeal has set back hearings scheduled for May and a new hearing date has not been set.
