Co. Court of Appeals Says District Court Wrong on PERA Issue

Earlier today the Colorado Court of Appeals ruled that a Denver District Court was wrong in dismissing a lawsuit brought against the Colorado Public Employees Retirement Assoc. (PERA).   In their decision the Court of Appeals said PERA retirees have a contractual right to a cost-of-living adjustment but that does not end the inquiry and that does not guarantee them a fixed  percentage of a cost-of-living adjustment for the rest of their lives.  The Court of Appeals has ordered the District court to re examine the contract and see whether or not the change in the cost of living adjustment was reasonable and necessary.  A group of PERA retirees filed suit in February of 2010, days after the legislation was signed into law,
